Sovereign cloud: data in Belgium, European jurisdiction

Where is your data actually located, and under which jurisdiction? What happens if a foreign government demands access? Are you truly compliant, or do you simply assume so? These are the questions currently facing executive boards. Read how eCloud provides the answer: Belgian data centers, European technology, and compliance.

Does this sound familiar?

We hear from many customers about the challenges they face regarding data sovereignty.

You don't know where your data resides

Your provider specifies an EU region, but determining who operates the infrastructure, who has technical access to it, and which jurisdiction applies turns out to be more difficult than expected.

Legislation does not stop at national borders

A non-European cloud provider can be legally required to hand over data to the authorities of its home country, regardless of where the servers are physically located.

Compliance is mandatory/requested.

NIS2 raises the bar for compliance. "Our data is in the cloud and we have backups" is no longer a sufficient answer to an audit question or a customer questionnaire.

What sovereignty means for eCloud

Your data resides in a location you know: your environment runs in professional data centers in Belgium. It is not merely in a generic region, but at a specific, identifiable location, utilizing resources dedicated to your organization within a network segmented by customer.

Belgian jurisdiction, Belgian point of contact: Epact is a Belgian company and part of the Belgian Cronos Group. The contract, the data processing agreement, and the personnel managing your environment are all subject to Belgian and European law. Should a request for access ever arise, it is clear who is responsible for evaluating it and under which framework.

European technology at the core of the stack: The virtualization platform underlying eCloud is Proxmox, developed in Austria. This is relevant for organizations that view sovereignty more broadly than just data residency.

Operational control remains transparent: You know who manages, monitors, and patches the systems, and the processes involved. These processes are ISO 27001:2022 certified, meaning they are auditable rather than merely documented.

The regulatory framework

What about NIS2?

What was long considered a best practice has become a requirement for a growing number of organizations.

After all, NIS2 explicitly requires organizations within its scope to implement measures regarding risk management, business continuity, backup management, and crisis management. With accountability at the management board level.

This has practical implications for your choice of infrastructure: you must not only implement measures but also be able to demonstrate them.

An ISO 27001:2022 certified partner, a data processing agreement with clear terms, and a tested failover procedure (complete with a report) are valuable assets in this regard.
